Pardons Canada: Can I Travel to the US with an Assault Conviction?
Visitor: As far as I know I don’t think I’m eligible for a pardon due to the nature of my crime. My biggest concern right now is not being able to find work because of my record. I have been offered jobs and then I was turned away when it came to a criminal background check. These jobs had nothing to do with my charges but unfortunately in Ontario employers are allowed to discriminate based solely on the fact somebody has a criminal record and not on whether or not their record could interfere with their work. Before I was arrested, I had a good paying job that I was at for 17 years. In response to your questions, I believe I was only fingerprinted once. I was arrested in North Bay, and my charges were accessing, possession and making child pornography. The accessing and possession were from downloading images and videos online. The making is because I had used a hidden camera to take videos in change rooms and other locations. I was arrested in June of 2016 and was sentenced in 2017. I was sentenced to 4 years, of which I served 2 and am currently on day parole. This isn’t something I’m proud of. I became addicted to pornography when I was 8 years old and it soon became my way of dealing with depression, anxiety, loneliness, boredom and stress. This is no excuse for what I did and it doesn’t justify it. But I am truly sorry for what I did and never want to be that person again. I lost everything because of this, my job, my home, my friends and the right to be with my son unless I’m supervised by another adult. I have never nor would I ever lay a hand on a child in an inappropriate way. My addiction was to the images and the videos. I just wanted to give you a bit of a background for what I was charged with. I know it probably doesn’t make a difference as far as getting a pardon. I had read that because my charges involved children that I’m not eligible for a pardon. If there’s anything you can do to help it would be greatly appreciated. Thank you.
Pardons Canada: In 2012 the Conservative Government changed the rules governing pardons which does not allow people to get pardons for criminal offences involving children. If your offence was before 2012 and you live in BC or Ontario then you can obtain a pardon for this criminal offence under the old pardon rules. If the victim is over 18 years old then you can get a pardon or record suspension 10 years after the end of your punishment.
