Demystifying Eligibility Criteria for Record Suspension
Visitor: I had an over 80 charge almost 5 years ago. April 10 2024 will be 5 years and i am looking into getting a pardon. How much do you guys charge for that?
Pardons Canada: The law to get a pardon or record suspension for an over 80 conviction is five years from when you paid the fine. The same rules apply to other driving criminal records including driving while ability impaired, commonly known as DUI, care and control of a motor vehicle, refusal to provide a breath sample, driving over 80 milligrams of alcohol in the blood.
A DUI can be a very expensive lesson as there are fines to be paid, lawyers to pay in court, driving re-instatement fees, back on track fees and increased insurance rates.
The first step in getting a pardon for the DUI is to get an RCMP file which will show the criminal record. Court records will then need to be gathered which show proof of fine payment. Local police check showing you have been out of trouble in the recent past and a personal letter showing remorse and rehabilitation.
