People are always in shock when they are denied entry at the US border due to an old criminal record. They are usually in shock because they never thought it would get in the way, or they traveled in the past and were never denied entry.
The Americans do random criminal checks which have become more common, so even if you have traveled safely in the past, there is a high likelihood that you will be stopped at the US border and denied entry if you have a criminal record or even if you have been charged with a criminal offence and the charges were later dismissed, withdrawn, stayed or discharged.
Once you have been denied entry to the US, you will need a US Entry Waiver (I-192 or I-194) to return to the US. The process of obtaining this application can be lengthy and complicated.
If you have never been denied entry to the US, its important to obtain a pardon, record suspension or file destruction so that your criminal record will be removed from record and cannot be seen by the Americans.
If you wish to apply for a Nexus pass, make sure your criminal record is removed, otherwise Nexus will be denied and even worse, they could deny you entry to the US as a result of uncovering your old criminal record.
Here is a recent email we received from a person who had an old petty theft conviction and denied entry to the US due to this very old criminal record:
“My 42 year old son was denied the right to fly into the US yesterday with his family,He has gone many other times with no trouble. He was told he has a criminal record.”
“His wife and son are now in Orlando Florida and he is back home in North Bay,very stressed as is his wife and son.”
“He did steal a cassette tape when he was a teenager, painted a church, cut church fire wood etc. and was told there would be no record,I phoned his home Police Dept. and they confirmed that to be correct, there should be no criminal record, why can these border people have so much power, not even a phone call to clear up the mistake,a ruined vacation, loss of lots of money and a very sad family.”
