Visitor: I’m a Canada civil servant with Correctional Service of Canada. I was accused of sexual misconduct, went to court and found not guilty of anything. I was giving a full acquittal. I applied for my records to be destroyed with the police and was told I needed to wait 3 years before my records were wiped clean. If I’m not guilty of anything why do I need to wait 3yrs and how do I do my job with police records hanging over my head.
Pardons Canada: The police can hold the file for as long as they wish as they may deem you to be a threat. There is very little recourse for you if you’ve already tried to do the file destruction without success. You have a non-conviction so its not criminal but it still shows up on a criminal background check.
