If you have been convicted of a criminal offence in the past in Calgary, served your sentence and have since shown yourself to be a law-abiding citizen, you may be eligible for a Record Suspension, which would effectively remove your record when anyone performs a criminal check. Calgary Record Suspensions, previously referred to as pardons, are reviewed for approval by the Parole Board of Canada.
The Record Suspension Process
An individual with a criminal record must wait either 5 or ten years following the completion of their sentence, depending upon the type of conviction, before applying for a Record Suspension. Preparing the application and gathering the supporting documentation takes on average between 3 and 10 months to complete. The process of preparing an application can begin before the end of the required waiting period. The review process by the Parole Board of Canada takes up to 6 or 12 months (depending on the type of conviction).
When an application is approved, the record of the criminal conviction is removed from the Canadian Police Information Center database, which is accessed for any criminal record search in Canada. The record is then sealed and kept separate and apart. It can only be reopened by the Ministry of Public Safety under exceptional circumstances, such as if a subsequent serious criminal offence has been committed. In other words, no one will be able to access your record as long as you do not re-offend.
Why Should You Get A Calgary Record Suspension?
Your past criminal conviction could come back and cause you trouble no matter how long ago it took place. Employers commonly conduct a criminal record check of new applicants and other employees in line for a promotion. An individual wishing to travel to other countries, including the U.S. may be refused entry by the local customs officer if a routine criminal check is performed. A criminal record can also be an obstacle for someone looking to rent a home or an apartment, petition for custody of a child or an adoption. It could also prevent you from getting Canadian citizenship or permanent resident status.
As Canada’s leading authority on pardons and Record Suspensions, Pardons Canada has helped thousands of Calgary residents get their criminal records removed.
