Visitor: I have a DUI from 13 years ago and have been denied NEXUS status as a result. I have been told by the NEXUS organization that getting a pardon will not make me eligible. Can you please confirm and advise as to what steps I should take to be NEXUS eligible?
Pardons Canada: A DUI or Impaired Driving is a criminal offence in Canada. Other driving offences that are criminal include, refusal to provide breath sample, driving over 80 mg of alcohol, care and control of a motor vehicle, and dangerous driving. The American side of Nexus is concerned with more serious offences and a DUI in the US is considered a misdemeanour rather than a full criminal conviction. However in Canada a DUI is considered a criminal offence so the Canadian side of Nexus will not accept the application if you have a criminal record. The good news is that the Nexus will be approved if you get a pardon for the DUI as the Canadian side of Nexus will accept that.
