I am just inquiring about the process of getting my non-conviction record destroyed and if I am eligible to do so.
October 25, 2019:
- Received 2 charges:
- Charge 1: Impaired Driving (Section 320.14(1)(a) of the Criminal Code of Canada)
- Charge 2: Impaired Operation Alcohol Over Limit 80mg% (Section 320.14(1)(b) of the Criminal Code of Canada.
August 09, 2021:
- Received a letter from my lawyer (Benjamin M. Lotery) stating that the Crown has stayed the charges against me and will no longer be proceeding against me.
August 29, 2022:
- As it has been over 1 year and the Crown did not bring the charges back into Court, I would like to request for non-conviction record destruction for the above stated charges.
Pardons Canada: A stay of proceedings is a good outcome for a DUI but you will need to apply for a file destruction as the record will still show up on CPIC or the RCMP file until that is completed.
