People are shocked to find out that their criminal charge still shows up on a background check even when the charge was withdrawn, dismissed, peace bond, diversion stayed and discharged.
This is a huge issue when trying to get work as a red flag is waived because your were fingerprinted by the police even though you were later found not guilty or recieved a discharge.
Here is a recent email we received highlighting this exact issue:
“Hello.a few years back I was falsely accused of theft I was arrested and charged and had my picture and finger prints taken after they realized that I didn’t do anything and I was innocent they threw it out of court and told me that it was stricken from the record.”
“So to my knowledge I thought this was the end of it. I am currently a personal support worker working in the health care feild with vulnerable people. I had applied and got a new job where they required a police check and a vulnerable sector check. When I went ahead and did this I was shocked to find out that that incident was still on my record !”
“I can not have that I need a clean record for the purposes of my career and the fact that I want to continue my education and go forth a get my nursing degree but I can’t do any of this if I have a record. I need it wiped clean I was told this was possible ? Please help. Thank you so much I really need to get this started my livelihood depends on it. Thank you.”
In this case the person requires a file destruction in order to remove her fingerprints, photos, court and police records. Then the police will have to agree to remove it from the vulnerable sector which can sometimes be denied.
